FAQs - Sex Crimes

What counts as a sex crime in Arizona?
“Sex crimes” covers a range of charges, including sexual assault, sexual abuse, sexual conduct with a minor, indecent exposure, public sexual indecency, prostitution-related offenses, sexual exploitation (including images), internet/online solicitation, and failure to register.

  Are sex-crime charges felonies?
Many are felonies, and some carry mandatory prison if convicted—especially when weapons, serious injury, or Dangerous Crimes Against Children (DCAC) allegations are involved. Even misdemeanors can trigger lasting collateral consequences.

What is DCAC and why does it matter?
Dangerous Crimes Against Children are offenses alleged to involve a victim under 15 in certain circumstances. DCAC designations can drastically increase sentencing exposure and limit probation eligibility. Early, focused defense can change the trajectory.

Do I have defenses in a sex-crime case?
Yes. Defenses can include consent (where legally applicable), lack of intent, alibi/misidentification, flawed forensics, unreliable interviews, digital-evidence challenges, and constitutional issues (stop/search/interrogation). Whether a “mistake of age” defense applies depends on the specific statute.

Will I have to register as a sex offender if I’m convicted?
Registration depends on the exact offense and outcome. Some convictions require registration for years; others do not. There may be limited paths to modify obligations later. Your lawyer will evaluate the risks and options before any plea or trial.

What should I do right now?
Do not contact the accuser. Don’t discuss the case with anyone but your lawyer. Preserve phones/computers/messages (don’t delete anything). Follow any release conditions and get experienced counsel involved immediately—pre-charge representation can be critical.
